The FCRA is a federal law that provides consumer rights and remedies for issues with consumer reports (also known as credit reports). The main points of regulation are that consumers have a right to get their own credit file, creditors can only ask for the a consumer’s report if they have a permissible purpose, and consumer reporting agencies (also known as “credit bureaus” or “CRAs”) must allow correct credit errors if the consumer disputes them.
A consumer reporting agency is a company the sell credit information about the consumers companies that will use it to make decisions about the consumer’s eligibility for credit, employment, or insurance. These companies gather information about consumer’s credit accounts, debts, and overall credit history. These companies may only issue reports if they believe the requesting party has a legally permissible purpose for the information.
CRA’s don’t have their own information about consumers, so they ask for that information from companies like credit card issuers, lenders, and debt collectors. Companies that provide that data to credit bureaus are called “data furnishers” or just “furnishers.” Consumers can dispute credit errors directly to furnishers, but should also dispute any incorrect information to the CRA’s.
When consumers disputes incorrect information to a consumer reporting agency, there are two separate credit investigations. First the CRA summarizes the credot report dispute letter and forwards that information to the furnisher. That furnisher must investigate the dispute and return the results to the credit bureau. The credit bureau then “reinvestigates” that same information. This two-step process is intended to insure that only accurate information stays in the consumer’s credit file.
The FCRA allows consumers to recover both actual damages and punitive damages against consumer reporting agencies and their data furnishers. “Actual damages” is compensation for any harm that has happened as a result of a violation of the Fair Credit Reporting Act. This would include compensation for credit denials, higher interest rates, humiliation and other emotional distress. Punitive damages can be awarded in cases where a CRA or lender has acted with willful disregard for consumer rights, and usually will be limited to some multiple of the actual damages between 1 and 10 times the amount of any actual damages.
In some cases, yes. But not all. The Fair Debt Collection Practices Act (FDCPA) regulates debt collectors and their credit reporting to the credit bureaus. This law does not govern the credit bureaus or furnishers who are debt collectors. But the FDCPA prohibits debt collectors from reporting false credit information or publishing disputed information without noting that the information is disputed. Consumers who are being overcharged or asked to pay for fraud accounts by .debt collectors can use the FDCPA get compensation for harm and stop damage to their credit history.
Yes, but it may not be worth it for you. Class actions are a lawsuit where a consumer seeks to get a remedy for themself and other consumers who have had the same thing happen to them. These lawsuits are a helpful way to correct a widespread problem, but consumers who file these suits are less likely to receive full compensation for their harms than if they filed their case only on their own behalf. While “incentive awards” have been used to help make up for the difference between what they consumer could have recovered on their own and what they get from a class action, these awards are being used less regularly and are more speculative than simply filing on your own.
